Shipping policy

This Shipping Policy outlines the shipping and delivery process when you purchase Products through Five Star Liquor and Wine’s Website. We may change this Shipping Policy from time to time. If any changes are made, we will update the date at the top of this Shipping Policy and, in some cases, provide additional notice (such as via email). We encourage you to review this Shipping Policy before making a purchase so you remain informed about our shipping requirements and delivery information. Unless otherwise defined herein, terms used in this Shipping Policy have the same meanings as in our Terms of Use.

1. LEGAL NOTICE

The Products are sold within the state or jurisdiction where Five Star Liquor and Wine is located, and title to the Products passes to you once they are delivered to a common carrier. By placing an order through our Website, you authorize us to have the Products shipped on your behalf by a common carrier for delivery to your chosen destination. Under the terms of sale, the common carrier acts as your agent. Please note that you may wish to insure your shipment as Five Star Liquor and Wine does not provide shipping insurance and has no control over the Products or their delivery.

2. ORDER PROCESSING

Once you have placed an order for Products through our Website, you will receive a confirmation that your order has been received. Within forty-eight (48) hours, we will notify you whether:

  1. Your order has been accepted and will be shipped;
  2. Your order has been accepted, but the Products are delayed or on backorder; or
  3. Due to complications, your order has been rejected.

In the event of a rejection, any credit card payment will not be processed.

If the Products you ordered are in stock, we will use our best efforts to ship them within 3–5 business days of notification. Tracking numbers will be provided via email through UPS or FedEx. 3. AGE VERIFICATION

Our Website and Services are intended for persons who are at least twenty-one (21) years of age. Persons under twenty-one (21) are not permitted to use the Website or Services in any way. By placing an order through our Website, you represent that you are at least twenty-one (21) years of age. Five Star Liquor and Wine reserves the right to request proof of identity before granting access to the Website or processing your order.

By placing an order, you verify that you and any order recipients are at least twenty-one (21) years of age. At the time of delivery, you or the order recipient must sign an age verification receipt confirming that they are at least twenty-one (21) years old and must present a valid driver’s license, military ID, passport, or State ID for identification. All shipments must be signed for.

According to UPS Policy, if no individual at least twenty-one (21) years of age is available to sign for the package and three (3) unsuccessful delivery attempts are made, the package will be returned to the shipper. The package may be reshipped for a fee of $20.

4. STATES

It is Five Star Liquor and Wine’s policy not to ship to certain states where the direct shipment of alcohol products is prohibited. Therefore, our Website will only allow orders to be placed for shipment to permitted states.

5. DELIVERY CHARGES

All deliveries are made by ground transportation through FedEx or UPS. Delivery charges may vary depending on the size, weight, and distance of the shipment. We are unable to deliver to a PO Box. Five Star Liquor and Wine will use its best efforts to notify you of any shipment delays due to weather conditions. For any shipping questions, please contact us at support@fivestarliquorandwine.com. Three delivery attempts will be made; if an adult is not available to sign for the package, it will be returned to us, and a reshipment fee of $20 will be assessed if you request that the package be resent.

6. DAMAGED PRODUCTS DISCLAIMER

You agree that Five Star Liquor and Wine shall not be responsible for any damage to Products that occurs during shipping. If any Products are damaged during shipping, please contact us at support@fivestarliquorandwine.com so that we may pursue a claim with the shipping company. Shipping charges are non-refundable. We strongly urge you to consider weather conditions prior to ordering, as exposure to extreme heat during warm weather or severe cold during winter months may damage Products during shipping. If you notify us that you would like your order to be held until more suitable temperature conditions prevail, we will do so at no additional cost.

7. SPECIAL SHIPPING TAXATION

Certain states require the collection of sales taxes on all orders containing alcohol products. Such tax rates may vary between states and will be added to your purchase price. You will be informed of any applicable sales taxes prior to payment.

Delivery can only be made to an address where an individual at least twenty-one (21) years of age is available to sign for the shipment during regular business hours. Products can be shipped to either a place of business or a residence. Both the purchaser and recipient must be over twenty-one (21) years of age to purchase alcohol.

Warning: Certain states expressly prohibit the direct importation of alcohol, and violations may be punishable as a misdemeanor or felony. Please contact your local alcoholic beverage control agency for further information. Additionally, some states may impose limits on the quantity and type of products that can be shipped to a single address.

FIVE STAR LIQUOR AND WINE AND ITS AFFILIATES MAKE NO CLAIM REGARDING THE RIGHTS OF USERS TO RECEIVE SHIPMENTS INTO THEIR STATE OR JURISDICTION. IF YOU ARE IN DOUBT ABOUT THIS MATTER, PLEASE CONTACT YOUR LOCAL GOVERNING BUREAU OR AGENCY BEFORE PLACING AN ORDER. VOID WHERE PROHIBITED BY LAW.
